Terms of Service

These terms govern your use of MagiCastor: the Moodle plugin, the application it opens, and the account area on this site. Creating an account or installing the plugin means accepting them, together with the privacy policy and, where we process personal data on your behalf, the data processing agreement.

MagiCastor is sold for professional use. If you are buying on behalf of a school, an institution or a company, you confirm you are allowed to commit them.

1. Who you are contracting with

MagiCastor is operated by Ldesign Media, registered with the Dutch Chamber of Commerce under number 86167979, at Vissershavenweg 65 - III, 2583 DL The Hague, Netherlands. Dutch law governs this agreement.

2. What the service does

The service reads material you provide, drafts a course plan from it, and, once you approve that plan, writes it and adds it to your Moodle site as a new course, or adds a SCORM module to a course you choose. Which activity types are available depends on what your own Moodle site has enabled.

Features change. We may add, improve or retire parts of the service, and we will give reasonable notice before withdrawing something you are paying for.

3. Your account and your licence key

You are responsible for what happens under your account and for keeping your licence key confidential. A licence key connects your Moodle sites to your subscription, up to the number your plan allows; anybody who holds it can spend your credits. Tell us promptly if you think one has leaked, and disconnect the site from the plugin’s settings page in Moodle, or ask us to.

Inside Moodle, who may build courses is decided by Moodle capabilities you control. Granting that capability is your decision and your responsibility.

4. Your material and your courses

Your material stays yours. So does every course built from it. We claim no ownership over either and we do not reuse them for any purpose other than producing the output you asked for.

You confirm that you are allowed to upload what you upload (that you own it, licensed it, or otherwise have the right to use it for teaching) and that doing so does not infringe anybody else’s rights.

To run the service we need permission to store, transmit and process that material. That permission is limited to providing the service to you, and it ends when the material does.

5. Generated material is a draft

The service writes course material with the help of an automated writing system. Output can be wrong, incomplete, out of date, or subtly unsuitable for your learners, and it is not reviewed by us before you see it.

You are the teacher of record. Everything the service produces is a draft for you to read, correct and approve, and the plan step exists so that you can. Do not publish generated material, and in particular do not assess students on generated questions, without reading it.

The service does not provide legal, medical, safety, financial or professional advice, and generated material must not be relied on as though it did.

6. Acceptable use

You may not use the service to:

  • create material that is unlawful, defamatory, or infringes somebody else’s intellectual property
  • upload personal data about learners or staff that you do not need to upload (the service does not need a class list to write a course)
  • attempt to extract, resell or resurface the underlying writing system as a service of your own
  • circumvent credit limits, licence checks or rate limits, or share one site licence across sites it was not issued for
  • overload, probe or reverse engineer our infrastructure, except where mandatory law permits it

7. Plans, credits and fair use

Each plan includes a monthly credit allowance, published on the pricing page. Credits are spent when you approve a plan and it is written, and when you ask for a section or an activity to be written again. Reading your material and drafting a plan costs nothing, and a plan you never build costs nothing.

Unused credits do not carry over to the next month unless we say otherwise in writing. If you run out, you can upgrade; we do not silently bill overage.

We may apply fair-use limits to protect shared infrastructure from automated or abusive volumes.

8. Payment and VAT

Subscriptions are billed in advance through Stripe. All prices are excluding VAT; VAT is added at checkout on the basis of your billing details, and EU businesses supplying a valid VAT number are reverse-charged. Providing correct tax details is your responsibility.

You can cancel at any time from your account. Cancellation takes effect at the end of the period you have paid for; we do not refund the remainder of a period unless mandatory law requires it or we have agreed otherwise in writing. Price changes apply from your next renewal after notice.

9. Availability

We aim for a reliable service but do not promise uninterrupted availability unless a separate written service-level agreement says so. Maintenance is announced where reasonable. We are not responsible for failures of your Moodle site, your hosting, your network, or third-party services we depend on.

10. Suspension and termination

We may suspend or end access for material breach of these terms, non-payment, or conduct that threatens the service or other customers, with notice where that is practicable.

Ending your subscription stops new builds. It does not touch courses that already exist: they are ordinary Moodle activities inside your own Moodle, and they stay there.

11. Liability

To the fullest extent Dutch law permits, we are not liable for indirect or consequential loss, including lost profit, lost data, or the consequences of publishing generated material you did not review.

Our total liability arising from the service is limited to the fees you paid for MagiCastor in the twelve months before the claim, or €100 if you have paid nothing.

Nothing here limits liability for intent (opzet) or deliberate recklessness (bewuste roekeloosheid), or any other liability that cannot lawfully be limited.

12. Changes to these terms

We may update these terms. Material changes are announced by email or in the product, normally at least 30 days in advance, and the date at the top of this page changes with them. If you do not accept a material change you can cancel before it takes effect.

13. Governing law and disputes

Dutch law applies. The courts of The Hague have exclusive jurisdiction, without prejudice to mandatory consumer protections where they apply. Both parties will attempt to resolve a dispute in good faith for at least 30 days before going to court, except where urgent relief is needed.
